In the span of one night, an owner of a small medical device distributor in Colorado lost his company. This company distributed medical devices manufactured by one of the world’s largest corporations, Stryker. For two decades, the owner developed relationships with doctors and businesses. These relationships were stolen, as well as their most tenured sales representatives, by Stryker. Over 10 employees received job offers from Stryker at 1 AM that morning and accepted it when they awoke. A situation like this, which was clearly coordinated, was in clear violation of a non-solicitation, non-diversion covenant. Meanwhile, the manufacturer company claimed they didn’t coordinate any of it.
