The firm just tried a partition action in Weld County. A lot of people have asked me to explain a partition action; our marketing people said I should do that here. In our case, a mother conveyed agricultural land and water rights to her three children. The children (and their successors) then fought about the land for years, sued each other more than once, etc. Most recently, two of them sued the third to force a sale of the land on the courthouse steps. We defeated the plaintiffs’ attempt to force a sale and then went to trial on what would be an equitable “in-kind” division of the property. The Court agreed with our position and issued a decree that conveyed the most valuable parcel to our client. Partition 101!
