On June 7 Chris Carrington of Richards Carrington LLC argued a criminal case before the Colorado Supreme Court. The appeal to the Supreme Court addressed whether a prosecutor may penalize an individual at trial by telling the jury that a person must have something to hide where the person exercised his or her constitutional right to insist that a police officer obtain a search warrant prior to conducting a search of that person’s blood for evidence of alcohol or drugs.
Richards Carrington LLC handled the landmark appeal without charge to the client in order to address what Mr. Carrington told the Supreme Court was an ongoing unconstitutional practice by the prosecution that was “offensive to the notions of fair play.” A decision on the issue by the Colorado Supreme Court is expected in the fall.
